The NUMBER ONE Question If Your Visa Is Delayed By Administrative Processing!

Today, I’m going to explain to you the number one question that I have for anyone who’s stuck in administrative processing. If your visa is delayed and the consul has told you that you have to go through administrative processing, then I have one huge question for you. I’m going to discuss it today.

In case you don’t know me, my name is Josh Goldstein. I’m an immigration lawyer in Los Angeles and I help people and families across the country and around the world get their visas out of administrative processing.

 

Unfair, unreasonable, and often illegal

Administrative processing is unfair, unreasonable, and in many cases, it’s actually illegal. I am dedicating my career to helping people who are stuck in administrative processing.

 

The solution I offer

The solution that I offer to people who are stuck in administrative processing is a mandamus lawsuit. People hire me, I file a lawsuit against the consulate, the state DEP, and against USCIS and other immigration agencies and officials.

After I filed the lawsuit, in the vast majority of the cases, people get their visas. The administrative processing is cleared up. It takes usually 6 to 12 weeks, and people are very happy with the outcome.

But the key problem for people is that no one wants a lawsuit. The last thing that anyone wants is to sue the government. Because for an immigrant, or someone from a foreign country, or even someone who’s a US citizen, it sounds crazy to file a lawsuit. It sounds like a horrible idea.

 

A special challenge for people from certain countries

Recently, I was talking with someone from Sudan. The visa for his wife was stuck in administrative processing. I was explaining to him that the solution was to sue the consulate, and he just thought that was insane. He just assumed that the consulate would get mad and deny the visa or that something terrible would happen to him.

My assumption is that if you live in Sudan, maybe in Khartoum, and you have a problem with something that the government is doing, the solution to that problem is probably not to sue the government. Here in the US, though, things work a little bit differently.

 

What I ask my clients

My number one question for anyone who’s stuck in administrative processing is this: What’s going to change tomorrow? What’s going to happen? If you think that the consulate is going to issue a visa to you if you continue to wait and you can wait it out, then by all means, you should continue to wait.

 

When you can’t take the pain anymore

But most people will reach a point where they can’t take the pain anymore. After they’ve been away from their wife, their husband or their family for several weeks, several months, or even years, there comes a point where they just can’t take it anymore.

That’s the point at which they begin to consider hiring us to file a mandamus lawsuit. Once we file the mandamus llawsuit, things are cleared up pretty quickly. But it’s overcoming the fear of the lawsuit that is the biggest impediment to getting a solution to the problem.

 

Ask yourself this question
