On February 2nd, 2021, President Biden signed an Executive Order on Restoring Faith in Our Legal Immigration Systems and Strengthening Integration and Inclusion Efforts for New Americans. The collection of three executive actions are focused on rolling back Trump Administration regulations and strengthening our country’s immigration policies. It is the latest part of a more comprehensive Biden Administration immigration agenda. Below, our Los Angeles immigration lawyer highlights the key things to know about the latest executive orders.
A ‘Top-to-Bottom’ Review of Recent Regulations and Administrative Guidance
As a starting point, President Biden has ordered a “top-to-bottom” review of recent regulations and administrative guidance that have set up additional barriers in our immigration system. It is a step in rolling back Trump-era immigration policies. The Executive Order includes instructions to conduct a full evaluation and assessment of the controversial ‘Public Charge Rule’—which punishes immigrants for using basic social services. Federal agencies must submit a review of any actions that they have taken and future suggestions for changes within 60 days of this order. From there, the Biden Administration will need to determine the best way to proceed.
Creation of a Task Force to Reunite Separated Families
Another Biden Administration Executive Order instructs the federal government to create a task force to reunite families that were separated by the Trump Administration. Family separation is one of the enduring legacies of the Trump Administration. Even into earlier 2021, many young children have still not been reunited with their parents and families. As of last fall, more than 540 still had not been connected to their family. Last November, Los Angeles County created its own task force to help reunite families. The Biden Administration is now looking to provide as much federal support as possible to ensure that all children separated from their parents under President Trump are reunited with their loved ones.
Review of Trump Asylum Policies and Creation of a Plan for Central American Migrants
Finally, a third Biden Administration executive order instructs federal agencies to review President Trump’s asylum policies and develop a long-term strategy for Central American migrants. Over the course of his time in office, President Trump consistently took action to restrict access to the asylum system. President Biden wants the federal government to create a sustainable strategy that effectively manages migration from Central America to the United States. What exactly this plan will entail remains to be determined. Though, it is clear that more needs to be done to help support vulnerable Central American migrants. This Executive Order could be an early step in the right direction.
